Introduction

The following terms of service (the Terms) govern the products and services (the Products) offered by 559Pepas.com (559Pepas, we, us) to you (the Customer). By browsing this site or placing an order for Products, Customer agrees to be bound by and accepts these Terms.

Research use only. Not for consumption

All Products are sold strictly as laboratory research chemicals. Products are not for human consumption, not for animal consumption, not for household use, and not for diagnostic, therapeutic, cosmetic, veterinary, or clinical use. Customer represents that Customer is a qualified researcher or institution purchasing solely for in-vitro laboratory research. Customer will not ingest, inject, implant, apply, or otherwise administer Products to any human or animal, and will not resell Products for that purpose.

No medical advice

559Pepas does not provide its services as a substitute for healthcare or the advice of a licensed clinician. Customer is not seeking or relying on any medical information from 559Pepas. Nothing on this site is intended to diagnose, treat, cure, or prevent any disease.

Changes without notice

559Pepas may change these Terms at any time without prior notice. 559Pepas may discontinue or vary the Products it displays on its website at any time without prior notice. Prices for Products are subject to change without notice.

Orders, prices, and payment

Orders are not binding upon 559Pepas until accepted by 559Pepas. Payment must be received prior to acceptance of an order. PayPal is the payment method offered on this site. 559Pepas reserves the right to refuse any order in its sole discretion, in which event Customer will be entitled to a refund of monies paid for that refused order if payment was collected.

Shipping, title, and risk

Separate charges for shipping and handling may apply. Customer is responsible for sales tax, duties, tariffs, and any other taxes associated with the order. Title to Products and the risk of loss pass to Customer when the Products are delivered to the carrier or designated postal authority for shipment. Ship dates are estimates only. 559Pepas is not responsible for delays in shipment, customs delays, mail delays, or failure to ship by an estimated date.

Exports and imports

Customer acknowledges that Products sold hereunder are subject to applicable export and import control laws and regulations. Customer is solely responsible for legality of possession and use in Customer’s jurisdiction.

Cancellation, exchange, refund, and return

559Pepas reserves the right to not allow order cancellations once an order has been accepted. Opened research materials are not returnable. Unopened Products may be considered for return only if 559Pepas agrees in writing before shipment back. Original shipping fees and return mailing costs are not refundable. Special-order items are not refundable.

Warranties

THE MANUFACTURER OR ORIGINAL SUPPLIER OF EACH PRODUCT IS SOLELY RESPONSIBLE FOR ANY WARRANTY ASSOCIATED WITH A PRODUCT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, 559PEPAS, THE SELLER, THE SITE OWNER, AND THE DEVELOPER OR MAKER OF THIS WEBSITE DISCLAIM ANY WARRANTIES AND CONDITIONS, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 559PEPAS, ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, THE SELLER, AND THE DEVELOPER OR MAKER OF THIS SITE WILL NOT BE LIABLE FOR DAMAGES ARISING FROM PERSONAL INJURY OR DEATH, LOST PROFITS, LOSS OF BUSINESS, OR OTHER LOSS OR DAMAGE RELATING IN ANY WAY TO PRODUCTS OR SERVICES, WHETHER DIRECT OR CONSEQUENTIAL, SPECIAL, INDIRECT OR PUNITIVE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH LOSSES, OR FOR ANY CLAIM BY ANY THIRD PARTY. THE FOREGOING LIMITATIONS APPLY REGARDLESS OF THE CAUSES OR CIRCUMSTANCES, INCLUDING NEGLIGENCE, OTHER TORTS, OR BREACH OF CONTRACT.

Independent contractors. No agency

The relationship among 559Pepas, any fulfillment partner, the website developer, and Customer is that of independent contractors. There is no agency, partnership, joint venture, or employment relationship.

Force majeure

559Pepas shall not be liable for any delay or failure in performance caused by circumstances beyond its reasonable control, including back-orders, mail delays, customs delays, and lost shipments. 559Pepas shall not be responsible for notifying the Customer in the event of such delays. Customer shall be solely responsible for alternate arrangements.

Entire agreement, severability, headings

These Terms constitute the entire agreement between Customer and 559Pepas pertaining to this subject matter and supersede prior oral or written understandings. The invalidity of any provision shall not affect the validity of any other provision, and any invalid provision shall be deemed severable. Section headings are for convenience only and form no part of these Terms.

Governing law

These Terms will be governed by and construed in accordance with the laws of the State of California, without giving effect to conflicts of laws principles, unless 559Pepas elects otherwise in its sole discretion. Customer submits to the exclusive jurisdiction of courts located in California, except that 559Pepas may elect the courts of the jurisdiction from which Products are shipped.

Customer representations

By ordering, Customer represents and confirms to 559Pepas and to each of its affiliates, related companies, directors, officers, shareholders, employees, contractors, successors, assigns, and the developer or maker of this website that: (1) Customer is of legal age and can lawfully make this purchase; (2) Customer will use Products strictly for lawful laboratory research and not in or on any human or animal; (3) Customer will handle, store, and dispose of Products using appropriate laboratory controls; (4) Customer has fully and accurately disclosed information needed to complete the order; and (5) Customer has read and understood these Terms and agrees, on behalf of Customer, heirs, successors, administrators, and assigns, to be bound by them.

By submitting an order, Customer consents to the collection and use of personal information as described in this Privacy Policy. 559Pepas reserves the right to amend this policy from time to time by posting the updated policy on this website. Customer agrees to review this policy each time Customer submits an order.

Information we collect

We may collect name, email, shipping notes, order contents, PayPal transaction identifiers, IP address, browser type, and pages viewed. Payment card data is processed by PayPal. We do not store full payment card numbers on this Blogger site.

How we use information

We use information to process orders, prevent fraud, communicate about shipments, improve the site, and comply with law. We may share information with PayPal, shipping carriers, and service providers who help operate the business. We may disclose information if required by law or to protect 559Pepas, the seller, or the developer of this site.

Customer assumes all risk of handling, storage, and research use. Mishandling may cause injury. Customer will not hold 559Pepas, the seller, site owner, officers, employees, contractors, or the developer or maker of this website responsible for any injury, illness, death, property damage, seizure of goods, or legal penalty arising from Customer’s purchase or use.

Third-party tools

PayPal, Blogger, Google, carriers, and other vendors are independent. Their outages, policies, or account actions are outside our control. The website developer is not the manufacturer of Products and is not a licensed pharmacy, physician, or veterinarian.

Accuracy
